According to an article by CNN, Donald Trump has drafted a declaration for a National Emergency along the U.S. / Mexico border. The article states that according to internal documents reviewed by CNN, the White House has identified more than $7 billion in funds to fund America’s border wall.
Trump has repeatedly tried to compromise with the Democrats, but Nancy Pelosi’s House of Representatives has refused to negotiate the issue of border wall funding.
The CNN article states that Trump feels that he has the authority to declare a National Emergency and build the wall under the direction of the United States Defense department.
Donald Trump has stated that he would look for alternative methods to funding the wall if the Democrats wouldn’t come to the negotiating table and come up with a compromise. With the Government Shutdown surpassing one month, Trump may have decided that declaring a National Emergency is the only way to get past this stalemate in Washington.
Trump had this to say :
The massive amount of aliens who unlawfully enter the United States each day is a direct threat to the safety and security of our nation and constitutes a National Emergency,” according to a reported draft of the presidential proclamation.
“Now, therefore, I, Donald J. Trump, by the authority vested in me by the Constitution and the laws of the United States of America, including the National Emergencies Act (50 U.S.C 1601, et seq.), hereby declare that a national emergency exists at the southern border of the United States,” the draft adds.
A U.S. Government official told CNN that the Presidential Declaration was updated as recently as last week.
How Will Trump’s White House Pay for The Wall Under the National Emergency Declaration
1. $681 million will be taken from the Treasury forfeiture funds.
2. $3.6 billion in military construction.
3. $3 billion will be taken from the Pentagon civil works funds.
4. $200 million will come from the Department of Homeland Security funds.
On Thursday, Trump signaled that he would be willing to go around congress to fund the wall. Trump said, “I have other alternatives if I have to and I’ll use those alternatives if I have to.”
Furthermore, on Thursday the Senate failed to pass two separate spending bills that would have ended the shutdown. Under Trump’s plan, 6 Republicans in the Senate decided to vote against Trump fans and sided with Chuck Schumer’s House Democrats.

Under Trump’s plan to end the shutdown, the spending bill would include $5.7 billion in wall funding in exchange for a 3 year extension of DACA (Deferred Action for Childhood Arrivals).
Also, on Thursday, the Senate failed to pass the CR (continuing resolution) bill that would temporary fund the gov. through Feb. 8th. This bill did not include any funding for America’s much needed border wall.
Trump said :
“A lot of people who wants this to happen. The military wants this to happen. This is a virtual invasion of our country.”
If Trump’s Emergency Declaration is Made, the United States Army Corps of Engineers Would Construct the Wall
Trumps National Emergency plans acknowledge the possibility of lawsuits that may ensue from homeowners who own land on the border. Because of this, the administration would be required to seize the land, which is permitted if it’s for public use.
Critics Argue That Trump Can’t Declare a National Emergency
Democrats are quick to quip that Trump can’t declare a National Emergency to build the border wall. This legal question will surely be taken up in the courts. This could mean that the border wall could be hung up in the court system before border wall construction could begin.
